Recall number 13168, 13-168, #13-168, #13168 Six Retailers Announce Recall of Buckyballs and Buckycubes High-Powered Magnet Sets Due to Ingestion Hazard Recall date: April 12, 2013 Recall number: 13-168 WASHINGTON, D.C.-- The U.S. Consumer Product Safety Commission (CPSC), in cooperation with six retailers, is announcing the voluntary recall of all Buckyballs and Buckycubes high-powered magnet sets sold by these companies. CPSC continues to warn that these products contain defects in the design, warnings and instructions, which pose a substantial risk of injury and death to children and teenagers.
Extract:
shtml These retailers have agreed to participate because Maxfield & Oberton has refused to participate in the recall of all Buckyballs and Buckycubes. In July 2012, CPSC staff filed an administrative complaint against Maxfield & Oberton Holdings LLC, of New York, N.Y., after discussions with the company and its representatives failed to result in a voluntary recall plan that CPSC staff considered to be adequate. This type of legal action against a company is rare, as CPSC has filed only four administrative complaints in the past 11 years. CPSC has received 54 reports of children and teens ingesting this product, with 53 of these requiring medical interventions. |

We believe this language, which is unchanged from the proposal, clearly defines the threshold for CPSC to consider immediate withdrawal of its acceptance of accreditation. (Comment 19) A commenter requests that the status of CPSC-accepted laboratories be disclosed publicly and that it should be readily ascertainable on the CPSC's Web site. The list of CPSC-accepted laboratories on the CPSC Web site at: http://www.cpsc.gov/en/Business-Manufacturing/Lab-Accreditation/, currently does not display whether a laboratory is categorized as independent, firewalled, or governmental. |
Extract:
Yet, in the interest of transparency the Commission has chosen to provide the information in a similar manner to the way in which the CPSC lists firewalled laboratories. As noted, the CPSC already lists firewalled laboratories on its Web site, despite the fact that the firewalled status applies only to a manufacturer or private labeler who owns, manages, or controls the laboratory. This practice will not change. (See http://www.cpsc.gov/en/Business—Manufacturing/Lab-Accreditation/.) In other words, the laboratory is considered independent for any other manufacturer or private labeler who may wish to use the laboratory's services.
Extract:
Section 1112.13(f) requires that CPSC Form 223 and all required accompanying documentation be submitted electronically via the CPSC Web site. We have established an electronic application system that can be accessed via our Internet site at: http://www.cpsc.gov/en/Business—Manufacturing/Lab-Accreditation/. This provision of the final rule is unchanged from the proposed rule. Section 1112.13(g) reserves the authority to require additional information from an applicant laboratory to determine whether the laboratory meets the relevant criteria.
Extract:
15(b)(28) of the final rule expressly allows for the use of test method CPSC-CH-E1001-08.2. Additionally, as discussed in response to Comment 8 in section II.A of the preamble, CPSC staff has posted two new test methods, CPSC-CH-E1001-08.3 (http://www.cpsc.gov/PageFiles/137829/CPSC-CH-E1001-08_3.pdf) and CPSC-CH-E1002-08.3 (http://www.cpsc.gov/PageFiles/137832/CPSC-CH-E1002-08_3.pdf), on the CPSC Web site. Sections 1112.15(b)(28) and (29) of the final rule have been revised to add test method CPSC-CH-E1001-08.3 as an option for laboratory accreditation for lead content in metal jewelry and children's metal products. |
